Keepova Terms of Service

This is the English translation of the document for the China mainland version of Keepova, the version currently available.

Welcome to Keepova. This Agreement is entered into between you and Hangzhou Luanshi Technology Co., Ltd. (“we”, “us”) and governs your use of the Keepova apps and the related cloud service (the “Service”). Please read it in full before use, paying particular attention to the disclaimers and limitations of liability in bold. By tapping “Agree and continue”, registering an account or starting to use the Service, you confirm that you have read, understood and agree to all of this Agreement.

1. The Service

The Service consists of three parts:

  1. Monitor app: you place a spare phone next to your aquarium. It continuously captures images and sound features, detects anomalies locally, and uploads relevant footage to the cloud for further analysis.
  2. Viewer app: on another phone, you receive alerts, review events and snapshots, and, when needed, start a live view or a “Take a look” snapshot.
  3. Cloud service: event evaluation and notifications, AI image analysis, real-time audio and video relay, media storage, the daily all-clear report, and related functions.

Specific features (including detectors, alert methods, video resolution and the time of the daily report) may be adjusted as new versions are released; when we add or change features, we will explain this in the app.

2. Accounts and registration

  • In mainland China you register with your mobile phone number; outside mainland China you register with an Apple account, a Google account or an email address. You must ensure that your registration information is true and accurate, and keep it up to date.
  • Each account is valid only in the region where you registered it (mainland China or outside mainland China). Accounts and data cannot be migrated between regions.
  • Your account may be used only by you (or the family members you authorise). Please keep your sign-in credentials safe. Actions taken through your account are deemed to be your own.
  • You can delete your account in the app at any time. A 7-day cooling-off period applies after deletion; when it ends, we will delete or anonymise your account data, and this cannot be undone.

3. Your responsibilities

  • Lawful use: you must not use the Service for any unlawful activity; you must not point the camera at other people’s homes, public areas or other people’s private spaces; and you must not film or distribute other people’s likenesses or private content. You are responsible for any dispute arising from the camera position and coverage you choose.
  • Monitor device: the monitor phone must remain powered, connected to the internet and switched on. Please make sure for yourself that it does not affect your home network or other devices. We are not responsible for missed alerts caused by power outages, network outages, device failures, the device being switched off by you, or operating-system restrictions.
  • Account security: you must not rent out, lend or transfer your account; you must not circumvent the permissions, limits or security measures we have put in place; and you must not use automated programs to access the Service in bulk.
  • No abuse: you must not reverse engineer, scrape, scan for vulnerabilities in or attack the Service. If you discover a vulnerability, please report it to us using the contact details in section 10, and do not disclose or exploit it.
  • Understand false and missed alerts: the Service makes judgements based on images and sound features. It is an assistive tool; it cannot replace your own care of the tank, nor can it replace professional veterinary, aquarium or electrical services. Alerts may be false or missed.

4. Subscriptions, payment and refunds

(The final wording of this section is to be settled together with the pricing plan.)

  • The free plan provides basic detection and alerts, with media kept for 7 days; a subscription provides benefits such as a longer media retention period (30 days) and higher-resolution live view.
  • Unless otherwise required by law or the store’s rules, subscription fees already incurred are non-refundable.

5. Our service and disclaimers

  • We will make reasonable efforts to keep the Service available and its detection accurate, but we do not promise that the Service will be uninterrupted or error-free. To the extent permitted by law, we are not liable for losses caused by: force majeure; carrier network or power outages; failures of third-party services such as app stores, cloud service providers or push channels; operation of the monitor device by you or others; or your failure to maintain the device as instructed (for example, not charging it or blocking the lens).
  • Alerts serve only as reminders. Do not use the Service as your only safety measure; in important situations (such as valuable fish, or long periods away with no one at home), please arrange separate manual checks.
  • To the maximum extent permitted by law, we are not liable for any indirect losses, loss of profits or loss of data arising from the use of or inability to use the Service; our total liability to compensate you for direct losses is capped at the fees you actually paid for the Service in the 12 months before the event.

6. Intellectual property and open-source software

  • The software, interface, text, trademarks (including Keepova and 看缸) and related technical achievements of the Service belong to us or the respective rights holders. You may not copy, modify, distribute or use them for commercial purposes without permission.
  • We use a number of open-source software components; their licenses and copyright notices are available in the app under Settings → About → Open-Source Licenses. Where an open-source license conflicts with this Agreement, the open-source license prevails for the software concerned.

7. Changes, suspension and termination of the Service

  • We may upgrade, adjust or partially discontinue the Service; where this materially reduces functionality, we will notify you in the app in advance.
  • We may restrict or terminate your use in any of the following cases: you breach this Agreement or laws and regulations; you endanger the security of the Service or other users; or you fail to pay subscription fees for an extended period.
  • You may stop using the Service and delete your account at any time; if we terminate the Service, we will handle your data in accordance with the law.

8. Minors

The Service is not directed at children under the age of 14 (outside mainland China, under the age of 16 or the equivalent age in your jurisdiction). Minors should read this Agreement together with a parent or guardian, and use the Service only with their consent.

9. Dispute resolution and governing law

  • Users in mainland China: this Agreement is governed by the laws of the People’s Republic of China. Any dispute arising from this Agreement shall first be resolved through friendly negotiation; if negotiation fails, the dispute shall be submitted to the people’s court with jurisdiction at our domicile (Hangzhou, Zhejiang Province).

10. Miscellaneous

  • This Agreement and the Privacy Policy together constitute the entire agreement between you and us regarding the Service. The rules for handling personal information are governed by the Privacy Policy.
  • When we update this Agreement, we will publish the new version and its effective date in the app and on the public page; material changes will be notified to you prominently, and your continued use means that you accept the updated Agreement.
